Ok first of all sorry guys wasn’t there active on blogville as i was suffering through an ailment called EXAMS....had a very hectic last week and plzzz one request dont ask how the exams were....THEY SUCKED BIG TIME
Now for past 1 month of so I have been hearing a lot about right to Fair trial...India being a very just country wants everyone to have equal opportunity to defend him/herself...A lot has been said about principles upon which Indian democracy is based and blah blah blah.....Now iam not against that. but sometimes I feel we just get too much tied with such thoughts , perceptions and values
I am not a big fan of Shiv Sena or MNS....But for once I really agreed to what Balasaheb Thackeray said in his news papers that.
”Kasab really doesn’t deserve a fair trail... Hang Kasab publicly near Gateway of India....
The fact remains that India is more concerned about what will rest of the world say of that lone terrorist is hanged in public.
The point that I don’t understand is why are we so worried about what people think…"where were these people when Mumbai was under attack, where were they when 100's of innocent people were killed mercilessly..
Inspite of all this we are still allowing him to make a mockery of the legal system…Its high time that we stop treating him like a guest and take stern actions..

Yes, I agree with u. When will people realize that by doing such acts, we are letting terrorists get away with their crimes. What is the need for a FAIR trail? Such inhuman acts should not be spared.
Here they delay the punishment.. and there a batch of 'Kasab' must be ready for another attack!

totally agree with you, kasab, or precisely any of those "terrorists" do not deserve this much of consideration, and yes, our judicial system is being mocked, but who cares what? high time the so called rulers grow up and think, grow up and act matured.

The judicial system is making a mock of itself and we as a country are fast falling behind in appearing to be tough on terror!
I don't believe that a terrorist needs a trial in the first place.....the evidence is strong, charges exist.....what more? He should be shot dead!

As long as the fair trial punishes him appropriately , I guess I am okay with a fair trial . . .But taking into account the delay's in our judiciary he would probably be hanged 10-20 years from now :(

Well, personally I think there is nothing that does not deserve a fair trial, but justice delayed is simply justice denied, plus they do not need to treat him like a prisoner of war, he is a terrorist, a self proclaimed one at that, the trials must be quick and the punishments- intense

Hey! You don't really know me. But I just read your blog and couldn't help but comment. Saying that he should be hanged publicly without a fair trial could have deep international repercussions.
1. There are more than 5 lakh Indian prisoners languishing in foreign jails. taking cue from what we do, they could reciprocate by killing them without a fair trial. (remember the case of Sarabjeet Singh?)
2. Our court follows the principle of stare decisis. This means that once a case is decided, it becomes a precedent for subsequent cases. 500 cases will turn up for public hanging and all will give the example of this particular case.
3. The true test of the soundness of our executive and judiciary is at stake. We would be running away from the close scrutiny of the efficiency of our laws and investigation agency.
4. We are signatories of a number of International Conventions and treaties (too many to name here) which put us under an obligation to give a fair trial and uphold natural justice. Otherwise, the consequences could be that we will emerge as the next 'taliban' and a mindless superpower would jump at the opportunity to 'civilise' us.
I could name a lot more reasons, but I think the aforementioned are more than enough to give voice to what I think.
